By accessing or using the website passionfuelsambition.org ("Website") and purchasing any digital products, courses, plugins, or services ("Services") offered by Passion Fuels Ambition ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not access the Website or purchase our Services.

These Terms constitute a legally binding agreement between you and Passion Fuels Ambition, a company registered and operating under the laws of the Republic of Singapore.

You must be at least 18 years of age or the age of majority in your jurisdiction to purchase our Services. By purchasing, you represent and warrant that you meet this requirement and have the legal capacity to enter into binding agreements.

If you are purchasing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Passion Fuels Ambition provides digital educational courses, color grading plugins, LUTs (Look-Up Tables), DCTLs (DaVinci Color Transform Language files), and related digital creative tools ("Digital Products"). All Digital Products are delivered electronically and are intangible goods.

Upon successful payment, you will receive access to your purchased Digital Products through your account on the Website or via email delivery. Access to online courses is provided through our learning management system.

We reserve the right to modify, update, or discontinue any Digital Product at any time without prior notice, provided that such changes do not materially diminish the core functionality of products you have already purchased.

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to use the Digital Products for your personal or professional creative work. This license is subject to the following restrictions:

You may NOT:
• Redistribute, resell, sublicense, or share the Digital Products with any third party
• Include the Digital Products in any product or service that competes with Passion Fuels Ambition
• Reverse-engineer, decompile, or attempt to extract the source code of any plugin or software
• Claim authorship or ownership of the Digital Products
• Use the Digital Products for any illegal or unauthorized purpose

You MAY:
• Use the Digital Products in unlimited personal and commercial projects
• Use output created with our products (e.g., graded footage, rendered images) without attribution
• Install plugins on devices you own or control

All content on the Website and all Digital Products are the exclusive intellectual property of Passion Fuels Ambition and are protected by Singapore copyright law, the Copyright Act 2021 (No. 22 of 2021), and applicable international intellectual property treaties including the Berne Convention.

This includes but is not limited to: course materials, video content, written content, plugin source code, LUT files, DCTL files, graphic designs, logos, trademarks, and any documentation provided with the Digital Products.

Unauthorized reproduction, distribution, or derivative works based on our Digital Products will be pursued to the fullest extent of the law.

All prices are displayed in United States Dollars (USD) unless otherwise stated. Prices are subject to change without notice, though changes will not affect orders already confirmed.

Payment is processed through our third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the total amount due.

All sales are final upon delivery of the Digital Product. Please refer to our Refund Policy for complete details.

ALL SALES ARE FINAL. Due to the digital and intangible nature of our products, we do not offer refunds, exchanges, or credits once a Digital Product has been delivered or access has been granted.

Digital Products cannot be "returned" in the traditional sense — once delivered, the content is immediately accessible and cannot be revoked. This policy is standard practice across the digital goods industry and is consistent with consumer protection frameworks in Singapore and internationally.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or share account access with unauthorized users.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PASSION FUELS AMBITION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE OR DIGITAL PRODUCTS.

Our total aggregate liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid for the specific Digital Product giving rise to the claim in the twelve (12) months preceding the event giving rise to the liability.

The Digital Products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify, defend, and hold harmless Passion Fuels Ambition, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Digital Products; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you create using our Digital Products.

Your use of the Website is also governed by our Privacy Policy. We collect and process personal data in accordance with Singapore's Personal Data Protection Act 2012 ("PDPA") and applicable data protection laws.

By using our Services, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Singapore.

You agree to waive any objection to the exercise of jurisdiction by the courts of Singapore and to the venue of such courts.

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet outages, or third-party service failures.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Website. Your continued use of the Website or Services after any changes constitutes acceptance of the revised Terms.
